    All at JackArmy.net would like to thank everyone who has played a part on this site over the past 25 years whether that is through writing, contributing, moderating, posting or just visting and reading.

    Without any of you the work that has gone into the site would have been pointless and we will always be proud that we built, generated and managed a community that was such a big part of the Swansea City supporting life for so long.

    It has been a pleasure to bring to you the site for so long but the time is now right to turn the lights out for the last time but we do it both with a heavy heart and a sense of pride driven by the so many messages received since we announced the closure.

    The site will remain here for a period until we archive and mothball it for the last time later this summer but all aspects are in a read only format.

Southampton waiting until their official relegation date

If these Southampton wide boys reckon the yanks are going to cave in to this kind of pressure, they clearly haven't been paying to attention. If they think the yanks are going to turn around on the day their championship status is confirmed and say "OK we'll take the lesser payment, you are a Championship club now" they're in for one hell of a shock. These guys will play the long game even if they're going to lose. They'll be more than prepared to take it to the week before the season starts and scupper any hopes of a top two finish that they were never going to get under Martin even if they'd have had it all sewn up a few weeks ago.

Southampton, if you don't think the yanks would cut their noses to spite their own faces, just try them fellas.

It's a legal/contractual thing isn't it? Wait until then to offer him the job, he accepts, and contractually it's the payment to a championship club that is due. So Yanks won't be able to do a thing about it.

As you say it's a legal/contractual thing isn't it.

Legal contracts can be a minefield depending how tight they are written or open to interpretation.

Is it at time of contact, and agreement by RM to accept the offer, or the time that he signs the paperwork?

Legal contracts shouldn’t be a minefield if they are drafted properly.

If we have drafted a contract with a release clause that doesn’t allow for promotion / relegation situations when the vast majority of moves happen at the end of a season, particularly following relegation, then we have incompetent lawyers or lawyers that have been instructed by the incompetent. It really is as simple as that.

No one who has been paying attention should be particularly surprised that Martin doesn’t put his foot down to help anyone other than himself. No one who’s been paying attention should be surprised that we didn’t anticipate this situation.

You know, it never entered my head for one second that they might have thought, 'What if it's a relegated club with parachute payments?'. Clearly it's to Southampton's advantage to wait it out, or they wouldn't be doing it, and they will have had legal advice. The Trust will know what's what, obviously, and be demonstrating their disquiet with some robust boot licking.

As I mentioned above I hope the contract would be tight and the clarity there

At time of first contact?
At time of permission to talk?
Signing of contract with new club?

A decent draft covers any reasonably anticipated scenario. There will be things from time to time that catch people out, but a team being relegated and in search of a manager shouldn’t be one of them. It’s just ridiculous.
 
I agree with London Lisa. This isn't an unusual scenario and any contract template will have included it in its possibilities.

I work for a very, very, extremely very, large international law firm in London so you can believe Lisa and me on this.

It's sad that we're outsiders now, unable to see inside, we don't have a clue what's what.. Southampton playing the waiting game seems that it's us who'll miss out on this proposed deal.. maybe it's all about Russ giving them the info, which indicates that the fist pumps galore from our weird fans in the east and on Twitter were stupid.. cheers Russ, you c*nt
