Has anyone seen this? There’s a SCC working strimming grass, and it puts a car window through! They have denied liability because they carried out a pre strimming examination of the area, honestly I would be absolutely fuming with this, if it happened to me.

This is a copy and paste of the reason they are not paying for the car window:

In a letter to Kerry the council said: "Claims of this nature are classed as legal liability claims and can only be paid if it is proven that the authority's negligence has resulted in the damage being sustained.

"Our parks department have a clear working protocol with instructions to undertake a full precutting inspection prior to commencing work, which is an accepted defence of a claim of this nature.":

What absolute BS, no way could the council do a decent examination for stones, when the grass is long, prior to cutting.

Saw that the other day, funny how the car window decided to shatter on its own, just as a council worker was strimming the grass.

Hell of a coincidence.

On another related note it is going to be interesting to see what happens in the next council election, which I believe are next year.

I’m quite annoyed with them, spouting legal mumbo jumbo to someone, and expect them to fork out for a new window now. Jesus Christ, I’d love to see my neighbours face, if was strimming and put their car window or house windows through, ‘Tis not my fault, I examined the grass thoroughly before strimming ’

I've had some back and forth with Rob Stewart on a number of things over the years, this doesn't surprise me.

He's not the easiest of people to deal with and behaviour can breed behaviour

Absolute bullshit, they must have 3rd part liability cover for such eventualities, do the right thing and pay the lady what shes owed. On aside note I doubt very much that they do a sweep before strimming, that costs time and money, and besides that's a get out, it's an accident own it and pay out. Times are hard enough for folk as it is, without having to deal with this nonsense. It's the same with pothole claims has anyone tried it recently.

She needs to take that on. Council will need to prove that they carried out a thorough sweep of the area, which they won’t be able to do.

Balance of probability. She’ll piss it in a court. It won’t even get to court anyway, councils insurers will pay it out because it will cost way more to defend it than pay for the new windscreen.

Withold paying your council tax, until the cost of the repair matches what you've withheld, plus a bit extra for the stress and inconvenience. But yeah, NJ is spot on.

The council are doing what private companies do, deny responsibility to see if the individual affected will take it further, at which point they'll pay out as NJ said. It's a very cynical approach as some people won't have the capability or funds to start the legal approach.

Yup. They’ll end up settling. This sort of thing happens all the time.

I'm a gardener and this is a common occurrence I don't doubt for one minute that the strimmer caused the damage

You cannot see stones in long grass and I always ask clients to move their cars when mowing or strimming as a small pebble can fly out like a ball bearing from a catapult and cause damage

Always wear eye-protection for the same reason - I've had a few cuts and bruises down the years to my legs and on a few occasions one has come up vertically and had I not been wearing a visor and goggles would have likely lost an eye

I see people mowing/strimming their lawns without protection and near to others oblivious to the risk but it does happen. I remember reading about a poor lad in a public park in Barry lost an eye some years back when a council lawnmower fired a stone out....
