Pedestrian Jailed For Manslaughter

I note in the case, they say it's a shared, but I think it's an unwritten rule that a cyclist would give way to a pedestrian?

The highway code hierarchy of road users gives the pedestrian the most protections, insomuch that a cyclist, next in the chain should give way to the pedestrian.
 
The problem is these days, local authorities are trying to shoe horn these cycle paths on existing highways, given the budgets available it is difficult to achieve. I would argue that if it's not up to standard, the scheme should never go be given the go ahead.
As to this case its absolutely tragic. We all have a responsibility as road users to look out for each other.

That's a good point, I was curious about this after watching the video, seeing how narrow the footpath was, and after a google it says the minimum width of a SUP should be 3 metres, where the accident occurred it was 2.4 metres. Though I would have thought, the defence would have picked up on that, that the width of the footpath was just an accident waiting to happen.

I suppose, ultimately the blame or partial blame for this happening has to
go to the ones who proposed this footpath being an SUP in the first place, thinking about this any proposal of an SUP on such a footpath so narrow is ludicrous once you factor the human element into it.

The human element is a mad thing, I was thinking earlier, I was down Singleton Hospital a while back, and after picking up a prescription from the pharmacy, I was walking back towards the main entrance, along the really narrow corridor, (where there is only room for 2 people) next thing these 2 bloody idiots enter the corridor from the main entrance, and they are walking side by side, I think what do I do pin myself to the wall, or walk backwards, nah I'll just keep walking one of them is bound to move, well they ferking didn't and just walked straight into me, and said ooo as if like where did you come from. Still puzzling me now what it was all about.

The point of that story is, humans are humans and they do the strangest things, so I think something like a SUP should consider the human element as a major factor in decision making.
