That's always been a murky area to be fair. Obama pardoned or granted clemency to a massive amount of people in his time in office. I would hope these kind of investigations are always running, no matter who is in office. It's a system that is massively open to abuse. Trump's mistake will be in being far too obvious about it and making it easy to accuse him of corruption.
